Terms of Service
These Terms of Service describe the rules that govern use of the Elivaria application, related services, connected review pages, generated outputs, subscription or balance-based purchase features, and any supporting interfaces that are made available to users. By downloading, accessing, or using the service, each user accepts these terms and agrees to comply with the product rules, platform requirements, and applicable law.
1. Acceptance and Eligibility
Use of the service is conditioned on acceptance of these terms. Users must be legally capable of entering a binding agreement and must not be prohibited from using the service under applicable law or platform policy. If a user acts on behalf of an organization, that user confirms that they have authority to bind the organization to these terms.
2. Service Scope
Elivaria provides a combination of social discovery, AI concept generation, saved profile history, favorites, post browsing, and store-related product access. Features may evolve over time, may vary by region or device, and may be modified, suspended, or discontinued when necessary for legal, operational, product, or safety reasons. We aim to describe paid and unpaid features clearly inside the service, but availability can change as the product changes.
3. User Responsibilities
Users are responsible for maintaining the confidentiality of account credentials, ensuring that uploaded or shared material is lawful, and avoiding conduct that abuses the product, harms other users, interferes with operations, or violates intellectual property or privacy rights. Users must not attempt to reverse engineer paid flows, disrupt AI generation systems, manipulate balance state, misuse moderation surfaces, or use automation in ways that degrade the service or unfairly distort product behavior.
4. Purchases, Subscriptions, and Billing
The service may offer balance top-ups, in-app purchases, or subscription-like features that unlock additional capabilities. Billing, renewal, cancellation, refund eligibility, and purchase processing are handled according to the rules displayed in the app, the operating system storefront, and applicable law. Product identifiers, pricing, and entitlement structures may change, and access to certain content or AI actions may depend on successful payment confirmation or sufficient balance.
Users are responsible for reviewing purchase details before confirming a transaction. If billing or entitlement issues arise, users should first review the storefront history associated with the device account and then contact support if further assistance is needed.
5. Intellectual Property and License
The software, interface design, branding, text, graphics, compilation, and other service materials are owned by Elivaria or its licensors unless another owner is identified. Users receive a limited, non-exclusive, non-transferable, revocable license to access and use the service for its intended purpose. This license does not grant ownership of the software, content pipeline, trademarks, or any proprietary output formats beyond the rights that applicable law or a specific product notice provides.
Users retain rights they already hold in content they submit, but they grant the permissions reasonably required for hosting, processing, display, moderation, support, and service operation. Users must not copy, resell, redistribute, or exploit protected service materials outside the allowed scope without written permission.
6. Moderation, Suspension, and Termination
We may review, remove, limit, suspend, or terminate accounts, content, purchases, or access when we believe there has been fraud, abuse, illegal conduct, infringement, harmful behavior, repeated policy violations, or material risk to the service or other users. We may also restrict access when required by law, security response, payment controls, or platform obligations. Suspension or termination may result in loss of access to stored data, community features, purchased balances, or generated outputs where permitted by applicable rules.
7. Disclaimers and Liability Limits
The service is provided on an "as available" and "as is" basis to the fullest extent permitted by law. We do not guarantee uninterrupted availability, error-free operation, permanent preservation of user content, or suitability for every commercial, professional, or personal purpose. AI-generated outputs, design suggestions, and discovery surfaces may contain limitations, inaccuracies, or results that require user judgment before reliance or purchase decisions.
To the extent permitted by law, we disclaim implied warranties and limit liability for indirect, incidental, special, consequential, exemplary, or punitive damages. Total liability, when it exists, will be limited according to applicable law and the amounts directly paid for the relevant service period if such a limitation is enforceable.
8. Changes, Governing Terms, and Contact
We may update these terms when the service, legal environment, billing structure, or product scope changes. Continued use after updated terms become effective constitutes acceptance of the revised version unless applicable law requires a different process. If any part of these terms is held unenforceable, the remaining provisions will continue in effect to the maximum extent allowed.
Questions about these terms, billing status, service availability, ownership concerns, or contact procedures can be directed to the Elivaria support channel referenced in the app or associated review materials. We review service questions carefully and respond in a commercially reasonable manner.
